The basis on which Garuda Helm accepts and carries out instructions for legal services.
These terms govern the relationship between Garuda Helm ("the firm," "we") and any person using this website or engaging our services ("you," "the client"). Please read them before submitting an enquiry or entering into an engagement. By using this website or instructing us, you accept these terms. If you have questions, we are glad to discuss them before any engagement begins.
1. Our Services
Garuda Helm is a Bangkok-based law practice specialising in wills, succession planning, and probate under Thai law. We provide legal services to individuals and families in Thailand, including Thai nationals and foreign residents with domestic or international succession requirements.
The services described on this website — Will Preparation & Registration, Cross-Border Estate Planning, and Probate & Estate Administration — are provided subject to these terms and any specific engagement letter or client agreement entered into with you.
2. No Solicitor–Client Relationship Without Engagement
Submitting an enquiry through this website, telephoning our office, or engaging in a preliminary conversation does not create a solicitor–client or attorney–client relationship. Such a relationship arises only when we have confirmed in writing that we are accepting your instructions and you have acknowledged the terms of our engagement, including our fees.
Until that point, information you provide to us is received in a pre-engagement context only. We will treat it with appropriate discretion, but our professional duties to you are limited until an engagement is formally established.
3. Information on This Website
Content published on this website is for general informational purposes. It does not constitute legal advice, and it does not address the specific circumstances of any individual. 4. Fees and Payment
Published fee schedules
Fee amounts published on this website represent the standard service fees applicable at the time of publication. They are subject to change and are provided as a guide rather than a contractual commitment. The fees confirmed in your engagement letter are the operative amounts.
Disbursements and third-party costs
Our service fees do not include government or court fees, translation costs, notarisation charges, foreign counsel fees, or other disbursements that may arise in the course of your matter. These will be communicated to you in advance where practicable.
Payment terms
Payment terms will be set out in your engagement letter. We typically require a deposit before work commences. Unpaid balances may result in work being paused until payment is received. We do not continue to act where fees are materially overdue without prior agreement.
5. Your Obligations
To allow us to act effectively on your behalf, you agree to:
- Provide accurate, complete, and timely instructions and information
- Inform us promptly of changes in circumstances that may affect your matter
- Respond to requests for information or approval within a reasonable time
- Not provide us with false or misleading information
We are not responsible for consequences arising from instructions or information provided to us that are inaccurate, incomplete, or delayed.
6. Confidentiality
We treat all client information as confidential and subject to professional privilege. We do not disclose client information to third parties except with your consent, as required by law, or as necessary to deliver the services you have engaged us for (for example, coordinating with foreign counsel in a cross-border matter).
This obligation of confidence survives the conclusion of any engagement. Our handling of personal data is described separately in our Privacy Policy.
7. Limitation of Liability
We carry professional indemnity insurance appropriate to the services we provide. Our liability to you in connection with any engagement is limited to direct loss caused by our negligence or breach of duty, up to the limit of our professional indemnity insurance or the amount of fees paid by you for the specific matter in question, whichever is lower.
We are not liable for indirect, consequential, or special loss, or for loss arising from circumstances beyond our reasonable control, including changes in law, court delays, or the actions or omissions of third parties.
8. Termination
Either party may terminate an engagement by written notice. If you terminate an engagement, you are responsible for fees earned to the date of termination. We may cease to act where continued representation would breach professional rules, where fees remain unpaid after reasonable notice, or where we no longer have the resources to act on your behalf appropriately, in which case we will notify you and provide reasonable assistance in transitioning your matter.
9. Intellectual Property
All content on this website — including text, design, and graphic elements — is the property of Garuda Helm and is protected by applicable intellectual property law. You may not reproduce, redistribute, or adapt website content without our written permission.
Legal documents prepared for you in the course of an engagement are yours for your personal use and purposes. We retain the right to retain copies for professional record-keeping purposes.

This website may contain links to external resources for your convenience. We do not endorse and are not responsible for the content, accuracy, or policies of any third-party website.
11. Governing Law
These terms and any engagement entered into under them are governed by the laws of Thailand. Any dispute arising from the use of this website or from our services shall be subject to the non-exclusive jurisdiction of the Thai courts, without prejudice to any rights available to you under applicable consumer or professional dispute resolution mechanisms.
