Do I need a Thai will if I already have one from my home country?
A foreign will may be recognised in Thailand in certain circumstances, but the process of having it accepted can be lengthy and complicated. A Thai will prepared under the Civil and Commercial Code provides a clearer path to estate administration here, particularly for assets held in Thailand such as property, bank accounts, or company shares. It is often advisable to maintain separate instruments for different jurisdictions.
What happens to a Thai will if I change my mind later?
Thai law allows you to revoke or amend a will at any time while you have the capacity to do so. A new will generally supersedes an earlier one, or specific clauses can be amended through a codicil. We include a complimentary review consultation two years after the initial engagement, and additional reviews can be arranged whenever your circumstances change.
How long does the probate process typically take in Thailand?
Uncomplicated probate proceedings — where there is a clear will and no disputes — can often be concluded within four to eight months. Where assets are more diverse, creditors are involved, or heir disputes arise, the timeline extends accordingly. We keep clients informed throughout and try to minimise unnecessary delays where we can.
Are there inheritance taxes in Thailand?
Thailand does impose an inheritance tax on estates above a certain threshold, with rates that vary based on the relationship between the deceased and the heir. The computation and filing of inheritance tax is included in our Probate & Estate Administration service. For cross-border situations, we also assess whether any tax treaties between Thailand and other jurisdictions may be relevant.
What information do I need to bring to an initial consultation?
A general overview of your assets (property, accounts, investments, business interests) and family situation is a good starting point. It helps to have identification documents available. You do not need to have everything organised before the first meeting — our role is to help structure the process around your circumstances, and many people find the initial conversation clarifying in itself.
